Street Structure
Settlement Between Owner and Arlington County Board of Zoning Appeals:
Summary
The settlement modified
the decision of the Board of Zoning Appeals as made on November 14,
2001, for the property known as 6430 27th Street North.
A variance is approved
to permit a setback of 7.1 feet instead of 8 feet from the eastern property
line and to permit a setback of 24.1 feet instead of 25 feet from the
right-of-way line of 27th Street North, subject to the following conditions:
1. Setbacks will
be measured from the façade wall of the building, not from the
foundation wall.
2. The Petitioner shall submit to the Zoning Administrator a wall-check
plat, certified by an engineer who has been approved by the Zoning Administrator,
which demonstrates that the building walls comply with the requirements
of this variance.
3. Shutters shall be installed on all windows except for windows in
the roof dormers
4. The three foot stone "knee wall" shall not be constructed.
The front yard (along Sycamore Street) will be landscaped and free of
construction materials or debris. If, at any time, the Petitioner chooses
to build any fence or wall, the Petitioner will landscape the area that
is outside of that feature and will maintain such landscaping. All construction
materials or debris will be removed from the site within the six-month
period for compliance with these conditions. The fence, wall, or other
feature shall comply with all requirements of the Arlington County Zoning
Ordinance. Landscaping will consist, at a minimum, of shrubs along the
fence, wall, or other feature, which shrubs are at least 12 inches high
at first planting.
5. If and when constructed, the six-foot rock wall around the house
will be constructed no closer than 3.5 feet to the edge of the sidewalk
to allow space for landscaping.
6. Two trees of at least a four-inch caliper, at first planting, will
be planted and shrubs of at least 12 inch height, at first planting,
shall be planted along the entire length of the edge of the driveway
and shall be close enough together to form a hedge.
7. The glass enclosed porch or another one-story architectural feature
similar in size and complies with the variance approved on February
10, 1999, will be constructed at that location.
8. The eaves on the house shall be modified so that all eaves comply
with all requirements of the Arlington County Zoning Ordinance
9. All conditions of the modified variance, except for maintenance of
landscaping, shall be met within six months of the date of entry of
this Order or the modified variance shall become null and void and of
no effect.
10. Compliance with this variance and the conditions thereon may be
enforced in any manner provided by law
11. This Final Order shall not be construed to approve any violation
of any Arlington County Ordinances except as expressly stated herein,
or as approved by the Arlington County Board of Zoning Appeals on February
10, 1999.
This order does
not modify the variance to permit a setback of 17 feet instead of 25
feet from the right of way line for North Sycamore Street, as approved
by the BZA on February 10, 1999.
